ORDINANCE NO. 2006-17

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SANTA MARIA, CALIFORNIA, AMENDING CHAPTER 12-48 OF THE SANTA MARIA MUNICIPAL CODE PERTAINING TO DENSITY BONUS

This ordinance will amend certain provisions of Chapter 48 of Title 12 (Zoning Ordinance) to comply with State law as follows:

Provide that state law requirements pertaining to density bonus apply in Santa Maria, regardless of whether the City has put corresponding Municipal Code amendments in place;

Modify density bonus opportunities to match those in State law;

Set out a procedure by which developers of affordable housing may request the particular incentives and/or concessions that would make their projects financially viable;

Set out findings required by state law to reject a developer’s specific incentive and/or concession requests;

Provide for density bonuses or concession/incentives when a qualifying development includes child care or makes a land donation that could be used for very-low income housing.

Additionally, the ordinance that would allow a development concession or incentive to be given to residential developments of less than five units if the applicant agreed to preserve the unit as affordable for the statutory period of 30 years.

NOTICE IS FURTHER HEREBY GIVEN that the City Council will consider adoption of Ordinance No. 2006-17 at its regular meeting on Tuesday, December 19, 2006.
