NOTICE IS HEREBY GIVEN that under provisions of Government Code Section 36933, Ordinance No. 2006-16 was introduced by the City Council of the City of Santa Maria at its regular meeting held on Tuesday, November 21, 2006. The following is a summary of said ordinance:

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SANTA MARIA, CALIFORNIA, REZONING 38.27 ACRES OF PROPERTY LOCATED ON THE NORTHEAST CORNER OF EAST MAIN STREET AND PANTHER DRIVE (GPZ-2005-003)
Said ordinance will rezone 38.27 acres located on the northeast corner of East Main Street and Panther Drive (formerly Freemont Street) from 38.27 acres of Open Space to 35.27 acres of Single Family Residential and 3.0 acres of Planned Development/General Commercial for the La Ventana II project proposed by Inland Pacific Builders. This property is located across Panther Drive from the La Ventana I development and Pioneer Valley High School. To the east and south is agricultural land. The project will consist of single family homes and a small commercial center on the corner of East Main Street and Panther Drive.
NOTICE IS FURTHER HEREBY GIVEN that the City Council will consider adoption of Ordinance No. 2006-16 at its regular meeting on Tuesday, December 5, 2006. Pursuant to Government Code Section 36933 after adoption, Ordinance No. 2006-16 shall be published in summary only. Said ordinance will prezone approximately 60 acres located on the west side of South College Drive and east side of Santa Maria Way to U.S. 101 to 31.8 acres of Residential Mobile Home, 5.9 acres of Planned Development/High Density Residential, 1.4 acres of Freeway Service, and 22.2 acres of Planned Development/General Commercial as part of the Quail Run Annexation Project (GPZ-2005-011, Annexation No. 105). The area currently consists of the proposed Orcutt Plaza site, Chevron Gas Station, Quail Meadows Condos, Quail Meadows West, Quail Meadows RV parking lot and the vacant remainder of the Adam Family Trust property.

Project Description: Hearing on the request of Urban Planning Concepts to consider Case Nos. 00GPA-06110, 01RZN-00011, 01CUP-00115, 00DVP-06009, [application filed October 12, 2000] proposing to amend the Santa Barbara County Comprehensive Plan Land Use Element-Orcutt Community Plan by changing the Land Use Designation from “PD 3.3” to “Recreation;” proposing to rezone 14.9 acres from “DR 3.3” to “REC” under provisions of Santa Barbara County Code Chapter 35 of Article III; for a Conditional Use Permit allowing a “swimming club” under provisions of Article III; for approval of a Development Plan to develop the Orcutt Aquacenter swimming and recreation facility; and to approve Mitigated Negative Declaration (06NGD-00000-00021) pursuant to the Guidelines for Implementation of the California Environmental Quality Act.
Project Location: The application involves AP No. 107-470-011, at the southeast corner of Hummel Drive and Union Valley Parkway, Orcutt area, Fourth Supervisorial District.
Public Hearing and Comment: Santa Barbara County P&D is soliciting comments on the adequacy and completeness of Mitigated Negative Declaration 06NGD-00000-00021. You may comment by submitting written or oral comments to the project planner identified below prior to the close of public comment on Friday December 29, 2006 at 5:00 p.m. Due to the non-complex nature of the project, a separate environmental hearing will not be held.
Project Details: The proposed project site is located near the southeast corner of Union Valley Parkway and Hummel Drive in the community of Orcutt. The project would provide a variety of water-oriented sport and recreation facilities, including: a 16,845 square foot main building, an Olympic-sized outdoor swimming pool, a 9,872 square foot building with an indoor swimming pool and other related facilities, a 4,357 square-foot storage building, outdoor water play equipment and picnic area, and 199 parking spaces. The proposed storage building would require the approval of a modification to reduce the required sideyard setback adjacent to a residentially-zoned property from 25 feet to approximately 20 feet. More detail regarding the project description is provided by the complete project description in the draft MND.
Environmental Review Findings: P&D has prepared Draft Mitigated Negative Declaration 06NGD-00000-00021 pursuant to Section 15073 of the State Guidelines for the Implementation of the California Environmental Quality Act (CEQA) and the County of Santa Barbara Guidelines for the Implementation of CEQA. P&D’s issuance of a Mitigated Negative Declaration affirms our opinion that any significant adverse impacts associated with the proposed project may be reduced to a less than significant level with the adoption of mitigation measures and that the project does not require the preparation of an Environmental Impact Report (EIR). The Mitigated Negative Declaration prepared for the project identifies and discusses potential impacts, mitigation measures, residual impacts and monitoring requirements for identified subject areas. Significant but mitigable effects on the environment are anticipated in the following areas: Aesthetics, Air Quality, Biological Resources, Geologic Processes, Hazardous Materials, Land Use, and Water Resources. If the project description changes, P&D will require a reevaluation to consider the changes. This reevaluation will be subject to all regular fees and conditions. If you challenge this environmental document in court, you may be limited to raising only those issues raised by you or others in written correspondence or in hearings on the proposed project.
Document Availability: If a copy of the Mitigated Negative Declaration is not attached, the draft MND may be obtained and all documents referenced in the MND may be reviewed at Planning & Development offices located at 123 E. Anapamu Street, Santa Barbara and 624 Foster Road, Suite C, Santa Maria.
