NOTICE IS HEREBY GIVEN that on July 6, 2006, at 8:30 a.m., or as soon thereafter as the matter may be heard in the above-entitled court, and the People will petition the court for permission to humanely destroy or otherwise dispose of birds or animals and all paraphernalia, implements or other property or things used or employed, or about to be employed, that were seized as a result of the above-referenced case and law enforcement investigation, pursuant to Penal Code 599aa. The ownership of three (3) of the seized animals or birds has been determined to be associated with the above-referenced defendant and ownership of 25 other seized animals or birds cannot be determined after reasonable efforts by the officer or other person named and designated in the order as custodian of the animals or birds may. The animals and birds have been held for a period of not less than ten (10) days.

This petition shall be published for (3) three successive days in a newspaper of general circulation and no animal or bird will be destroyed or otherwise disposed of until four (4) days after the date of this order.

Said petition will be based on the files and records herein, the attached affidavit stating the affiantís basis for his or her belief that the property and items taken were in violation of the Penal Code, and other evidence as may be presented at said hearing.

At least 10% of the amount bid must be paid with the offer and the balance must be paid on close of escrow after confirmation of sale by the Court. Escrow will close on or after court confirmation at the hearing on July 28, 2006.
